1. Acceptance of Terms

By downloading, installing, or using the AutoGauge application on iOS or Android, the AutoGauge Chrome extension, or related websites (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

Our Privacy Policy explains how we collect and use personal information and is part of these Terms.

2. Description of Service

AutoGauge provides AI-powered car analysis tools that may include:

Market value estimates based on listing and market context
Flip score and profit potential tools
Condition-oriented notes from photos
Repair cost estimates
Safety, recall, and depreciation-related information from third-party sources
A garage for vehicles you add, including mileage and maintenance reminders
Scanning via pasted or shared listing links, the Chrome extension on a Facebook Marketplace page, and photos you capture or upload

Features may change over time. AutoGauge is an estimate and research aid. It is not a vehicle inspection, a title or accident-history report, a lender, or a dealer.

3. Accounts

Some features require an account. You are responsible for:

Providing accurate account information
Keeping your login credentials secure
All activity under your account

You may sign in with email and password, Sign in with Apple, and/or Google Sign-In where available. You must be old enough to use the App under applicable law, and at least 13.

4. Free Access, Trials, Subscriptions, and One-Time Purchases

Free Access

Creating an account is free. Features that do not run a scan, such as viewing reports already saved on your device, can remain available without a purchase. Running a scan requires an active subscription, a free trial, or scan credits from a one-time scan pack.

We previously granted new accounts a limited number of free scans. That offer has ended. It is no longer available to new or existing accounts, including any account that had not yet used it. Scan credits you purchased, and any active subscription or trial, are not affected.

Free Trials

Where offered, a subscription may include a free trial. Trial length and eligibility are shown in the App Store or Google Play purchase sheet, web checkout, and/or the App paywall. Unless you cancel before the trial ends, the subscription converts to a paid auto-renewing plan at the then-current price.

A free trial may include a limit on how many scans you can run. That limit is applied in the App. Reaching it does not end the trial period, but it can stop new scans until the trial ends or you subscribe.

Paid Subscriptions

On iOS and Android, subscriptions are billed through the Apple App Store and/or Google Play
In the Chrome extension, subscriptions may be billed through Stripe (via RevenueCat Web Billing)
Prices, billing periods, and the scan allowance are shown before you confirm purchase
Where a plan is described as unlimited, we do not apply a monthly scan cap. We can still suspend automated, resold, or abusive use under Section 5
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period, or earlier if the store requires it
Manage or cancel in:

- iOS: Settings → Apple ID → Subscriptions - Android: Google Play → Payments & subscriptions → Subscriptions - Chrome / web: the billing portal linked from checkout

Refunds for App Store and Play purchases are handled by Apple or Google. Refunds for web checkout are handled through Stripe or our billing provider. We do not promise a refund outside those policies.

Promotional discounts, including an offer shown if you start to cancel, are optional. We may withdraw an offer. A discount applies only as stated at the time you accept it, and only to the renewal it describes.

One-Time Purchases

We may offer consumable products such as scan packs (a set number of scans). These are one-time purchases through Apple, Google, or web checkout. They are not subscriptions and do not auto-renew. Unused credits stay on your account until used, unless the App states an expiration when you buy them.

Pricing Changes

We may change prices for future periods. Apple, Google, and Stripe rules govern how a price change applies to an existing subscriber.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or disassemble the App, except where the law does not allow that restriction
Use bots, scrapers, scripts, or other automated systems to access the App or our APIs
Resell, sublicense, or commercially redistribute analysis, or use the App as the engine of another product, without our written permission
Submit content that is illegal, harmful, or infringing, or that you do not have rights to use
Interfere with other users, or attempt to bypass paywalls, quotas, or security
Misrepresent a scan result as a certified inspection, appraisal, or vehicle-history report

We may suspend or terminate access for violations, including automated or resold use, without a refund except where the store or the law requires one.

6. Your Content

You keep ownership of the photos, links, and vehicle details you submit. You grant AutoGauge a limited license to host, copy, and process that material, and to send it to our AI and listing-retrieval providers, only to operate, secure, and improve the App.

You represent that you have the right to submit that material. Listing pages belong to their owners. Submitting a public Marketplace URL so we can analyze it does not transfer that listing to you or to us.

7. Third-Party Services and Listings

The App relies on third parties, including Facebook Marketplace, Apple, Google, Meta, Stripe, RevenueCat, AI providers, and government data sources such as NHTSA. We do not control those services or the listings you submit. We are not responsible for their content, availability, accuracy, or policies.

A listing we retrieve can be incomplete, outdated, or wrong, including price, mileage, location, options, and photos. You are responsible for verifying anything that matters before you buy, sell, or negotiate.

Sharing a listing URL into the App, including through the system share sheet or the Chrome extension, is optional and is also subject to that platform’s rules.

8. Disclaimers

Not Financial, Legal, Inspection, or Professional Advice

AutoGauge provides estimates and AI-generated analysis only. Valuations, flip scores, condition notes, repair estimates, and profit figures are not guarantees, appraisals, inspections, title searches, or financing advice. They should not be your only basis for buying, selling, pricing, or financing a vehicle.

Accuracy

Markets change quickly. An estimate can differ from the price a car actually sells for.
Photo notes cannot find every mechanical, structural, flood, odometer, title, or history problem.
Repair estimates are approximate and vary by region and shop.
Recall and safety data can be missing or delayed.
A high flip score is not a promise that you will make money.

Get a professional inspection and do your own due diligence before a transaction.

“AS IS”

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Limitation of Liability

To the maximum extent permitted by law, AutoGauge LLC and its developers are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, vehicles, or goodwill, arising from:

Your use of or inability to use the App
A vehicle purchase, sale, or negotiation that used our analysis
Inaccuracies in valuations, reports, listings, or estimates
Unauthorized access to your account
Third-party services, stores, ads, or data

Our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us for the App in the 12 months before the claim or (b) USD $50, to the extent that cap is allowed by law.

Some jurisdictions do not allow certain limitations. In those cases, our liability is limited to the maximum extent the law allows. Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud or for death or personal injury caused by negligence where the law forbids that limit.

10. Indemnity

To the extent permitted by law, you will indemnify and hold harmless AutoGauge LLC and its developers from claims, damages, and reasonable expenses arising out of your use of the App, a vehicle transaction you make, content you submit, or your violation of these Terms.

11. Intellectual Property

The App, including its design, software, branding, and models, is owned by AutoGauge LLC or its licensors. You may not copy, modify, distribute, or create derivative works from the App without written permission.

Analysis results generated for your scans are yours to use for your own personal or internal business purposes. You may share an individual result. You may not systematically scrape, extract, or republish App data, or present it as your own product.

12. Privacy and Communications

Your use of the App is also subject to our Privacy Policy. If you enable push notifications, we may send transactional or product messages, for example when a scan finishes or a garage reminder is due. You can disable notifications in device settings.

If a payment does not go through, we email you so you can update your card. After your subscription access has ended, we may email you about buying scans without a subscription. Unsubscribe in that email stops those scan-pack emails.

13. Account Termination

You may delete your account in the App’s Settings. Deleting your account removes account-linked data we control, as described in the Privacy Policy and the deletion instructions. It does not cancel an active Apple, Google, or Stripe subscription. Cancel that in the store or billing portal.

We may suspend or terminate accounts that violate these Terms or that create risk for the service or other users.

14. Apple App Store and Google Play

If you downloaded the App from the Apple App Store, you acknowledge:

These Terms are between you and AutoGauge LLC only, not with Apple. Apple is not responsible for the App or its content.
Your license is limited, non-transferable, and revocable, and lets you use the App on Apple-branded devices that you own or control, as allowed by the Apple Media Services terms.
AutoGauge LLC, not Apple, is responsible for maintenance, support, and any product warranties. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App. To the maximum extent permitted by law, Apple has no other warranty obligation.
AutoGauge LLC, not Apple, is responsible for addressing claims relating to the App, including product-liability, legal, and consumer-protection claims, and any claim that the App infringes intellectual property.
You represent that you are not located in a country subject to a U.S. government embargo and that you are not on a U.S. government list of prohibited or restricted parties.
You must comply with applicable third-party terms, including your wireless carrier’s terms, when using the App.
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and Apple may enforce them against you.

If you downloaded the App from Google Play, these Terms are between you and AutoGauge LLC, not Google. Google is not responsible for the App or for support. Google Play’s terms also apply.

15. Disputes and Governing Law

Before you file a claim, email support@autogaugeai.com and give us a reasonable chance to resolve the dispute, unless the law lets you go straight to small claims court or a regulator.

These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules, unless a mandatory consumer protection in your place of residence says otherwise. Courts located in California have jurisdiction, subject to those mandatory protections.

16. Changes to Terms

We may update these Terms from time to time. We will update the “Last Updated” date and post the revised Terms. Continued use after the changes take effect means you accept them. If you do not agree, stop using the App and cancel any subscription.
